Here to talk about an interesting development in on the federal scene earlier this year with the Obama executive order regarding floodplain management and the federal flood risk management standard developed by FEMA that is a complement to that could you first explain what these are and what significance you think they have in the
Overall hazard field certainly Jim at the end of January President Obama issued executive order 13 6 90 which actually amended executive order 11 9 88 as you may be aware executive order 11 9 88 has been with us since the late 1970s and it was the federal government’s executive order on floodplain management
So what the president what President Obama’s executive order actually did was revise that older executive order to include a new way of thinking about federal actions in floodplains so the federal flood risk management standard which is a component of that executive order identifies three new techniques and performance standards for
All federal actions taken in floodplains and so again it’s an it’s a revision to the long-standing executive order 11 9 88 and it does apply to all federal actions okay and then the flood risk management standard does what so the flood risk management standard let me go
Back to what a Oh 11 9 88 was because it had a de facto flood risk management standard which was the equivalency to the National Flood Insurance Program standard basically new construction buildings things like that needed to be protected to the base flood or 100-year flood elevation the federal flood risk
Management standard actually changes that and it takes it directs agencies to take one of three approaches depending on the needs of the project and the program so the first of those approaches is called the freeboard approach and basically for any action that is not considered a critical action you build
In a two-foot freeboard or essentially a height above the hundred-year flood standard to account for uncertainty climate change in those types of things for critical actions that needs to be a three-foot freeboard the second approach is actually called the 500-year standard and it basically says that for any federal action the protection level
Needs to be the 500-year standard and then the third alternative is actually called the climate informed science standard and that basically requires that the flood protection standard be informed by the best available climate science in areas where we have that information so example in our coastal areas Jim we have good information on
Future sea level rise and so the climate inform science approach in a coastal area what account would fully account for the sea level rise impacts as well as any other climate change impacts that might occur okay so let’s explore I mean first just for those who may be a little
Unclear on the terminology when we talk about the 100-year flood standard talk about something that is statistically deemed to be a 1 percent chance of occurring in a particularly you know that’s right Jim and actually there’s people misinterpret that sometimes where they think geez we just had a 100-year flood last week we’re
Safe for the next 99 years and you’re absolutely correct it really is more about the statistical probability of an event happening has having a 1% chance of happening in any given year right and so then 500 years one-fifth of 1% chance and so on correct you can play out the
Statistics from there so from a planning perspective how would you describe the significance because let me preface my question you know one of the interesting things that I’ve seen is applying those statistics to say a 30-year mortgage on a new home built in a particular location we’re then talking about a 27%
Chance over those 30 years because you multiply out you compound those 1% chances and suddenly you’re looking at a pretty good chance of having something happen during the life of that mortgage let alone the extended life of that house you know that’s correct and and recognizing that planners practice in a
Variety of ways within a community it could impact planners in different ways but I think two of the primary ways that the standard is going to impact planners one would be direct federal projects where the federal government is actually undertaking development so maybe there is a military base you know a National
Guard barracks that need to be built and and those kinds of direct federal investments those federal investments are going to need to comply with this new standard and so in as much as the the community planners are working with the federal agency to be aware of those three options in which option the
Federal agency is taking I think becomes very important and the second way I think is going to come when the when especially when a community applies for federal grants to do construction activity one of the easiest examples and one that we actually have confirmation from FEMA that the new standard will
Apply to are the federal hazard mitigation grant program so the hazard mitigation grant program flood mitigation assistance pre-disaster mitigation and those are programs where depending on the program it could be pre or post flood funds are available to reduce the risk on buildings so you know
You might get funding to elevate a house that’s in a floodplain that’s at risk and and FEMA has come out with a fact sheet recently that it didn’t that those projects will have to meet the new standards even if local codes have a standard that’s somewhat less
Than that and so the planner is going to again need to be aware of the approach that’s preferred by the agency and making sure then that grant applications and budgets and everything reflect any kinds of increases of cost of construction or larger building footprint or those types of things so
Again I think it’s both in the direct federal investment arena as well as in grants where planners are going to need to pay particular attention yeah so basically you have other standards at your local level you can do what you want with your own money right local
Funds but once you get into that arena of federal assistance or federal investments you’re in a different ballgame and you know that this is an area that I think there’s a bit of confusion but you characterized it absolutely correct whenever you’re using 100% of your own money or perhaps even
Your local and state money or those types of things and you have no federal involvement the federal flood risk management standard will not apply but once you start bringing in some of that even if the federal funding is just a small component then the chances are increased greatly that that federal
